Selling a home

What do local home sellers need before selling?

It depends on the home. Sellers need a certificate of compliance from the local fire department showing the smoke and carbon monoxide alarms meet sale requirements. For a home built before 1978, sellers must give the buyer the lead paint notice and any lead inspection reports before signing a purchase and sale agreement. A home with a septic system generally needs a Title 5 inspection within 2 years before the sale.

Will I owe tax when I sell my home?

If you sell your main home at a gain, you may be able to exclude up to $250,000 of that gain, or up to $500,000 if you file jointly, when you meet the IRS ownership and use tests. Generally, you can’t take the exclusion if you took it on another home sale in the 2 years before.

I’m behind on my mortgage. What are my options?

The local Attorney General’s Office urges homeowners to contact their mortgage servicer early. Options can include a loan modification, forbearance, a repayment plan, a short sale or a deed-in-lieu. A short sale or deed-in-lieu means giving up the home, and it can still leave you owing the lender or with serious tax consequences. Foreclosure counseling from a HUD-participating housing counseling agency is always free.

Landlords and Section 8

How does Section 8 work for landlords?

You screen tenants and sign the lease as usual. The unit must pass an inspection, the rent must be reasonable for the area, and the housing agency pays its share directly.

Can a local landlord turn down a Section 8 tenant?

Not because of the voucher. Local law bars discriminating against renters who use Section 8 or other public assistance, or refusing to cooperate with the program’s requirements. Ads that say “No Section 8” are illegal.

What are the local security deposit rules?

A landlord may collect a security deposit equal to one month’s rent, and it must be held in a separate, interest-bearing account in a local bank. The landlord must give the tenant a receipt with the bank details within 30 days, and tenants who stay at least a year are owed interest on it. Not returning the deposit within 30 days after the tenancy ends can mean triple damages.

Are Section 8 inspections changing?

Yes. HUD’s newer NSPIRE inspection standards are coming to voucher units. Local housing agencies may keep using the older standards until February 1, 2027, and may switch sooner.

Investing

What is a 1031 exchange?

When you trade business or investment real estate for like-kind business or investment real estate, you generally don’t recognize a gain or loss. If you also get cash or other property, you recognize gain up to its value. Property held mainly for sale doesn’t qualify.

What counts as rental income?

Rent, advance rent and expenses a tenant pays for you count as rental income. A security deposit you may have to return doesn’t. Many rental costs, like repairs and depreciation, can be deducted.
